This serves as notification from the Coastal Marshlands Protection Committee and the Georgia Department of Natural Resources of a request from Jones Creek Landing Community Association, Inc. for a Coastal Marshlands Protection Act (CMPA) permit under Official Code of Georgia (O.C.G.A.) 12-5-280 et seq., to modify the existing Tier Three community dock facility located on Jones Creek, St. Simons Island, Glynn County, Georgia. The proposed project is under 1/10 of an acre and therefore may be considered a minor alteration of coastal marshlands under O.C.G.A. 12-5-280 et. seq.
The community dock facility was authorized by CMPA Permit #322 issued August 29, 1996. The existing Tier Three community dock consists of a 6ft. x 538ft. (3,228sq.ft.) walkway leading channelward from the upland to a 24ft. x 24ft. (576sq.ft.) fixed deck. Extending north from the fixed deck is a 4ft. x 26ft. (104sq.ft.) gangway used to access an 8ft. x 40ft. floating dock (320sq.ft.). Extending south from the fixed deck is a 4ft. x 26ft. (104sq.ft.) gangway used to access an 8ft. x 40ft. floating dock (320sq.ft.). The dock facility extends approximately 15ft. into Jones Creek at Mean Low Water (MLW). Existing impacts to coastal marshlands total approximately 4,652sq.ft. (0.11 acres).
The applicant proposes modifying the community dock facility by removing the existing ramps, floats, and 35sq.ft. of the existing fixed deck. These components will be replaced with a 4ft. x 26ft. (104sq.ft.) ramp extending channelward from the fixed deck to a 10ft. x 100ft. (1,000sq.ft.) floating dock. The terminal end of the facility will be constructed 17.12ft. from the straight-line extended property line to the left and 106.99ft. from the straight-line extended property line to the right of the structure. The dock facility will extend approximately 32.92ft. into Jones Creek where it is approximately 98.75ft. wide at MLW. The proposed modifications will result in approximately 1,104sq.ft. (0.02 acres) of new impacts to coastal marshlands. Total impacts to coastal marshlands for the existing facility and proposed modifications are 5,756sq.ft. (0.13 acres).
The community dock qualifies as a “Tier Three Community Dock” in accordance with The Rules of The Georgia Department of Natural Resources Chapter 391-2-3-.03, Regulation of Marinas, Community Docks and Commercial Docks.
The proposed project does not have an upland component.
It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. Impacts to coastal marshlands must be minimal in size. In passing upon the application for permit, the Coastal Marshlands Protection Committee shall consider the public interest: (1) Whether or not unreasonably harmful obstruction to or alteration of the natural flow of navigational water within the affected area will arise as a result of the proposal; (2) Whether or not unreasonably harmful or increased erosion, shoaling of channels, or stagnant areas of water will be created; and (3) Whether or not the granting of a permit and the completion of the applicants proposal will unreasonably interfere with the conservation of fish, shrimp, oysters, crabs, clams, or other marine life, wildlife, or other resources, including but not limited to water and oxygen supply.
