Simon Richardson and Robert Forrest, Modification of an Existing Single-Family Residence, 6 Lovell Avenue, Tybee Island, Chatham County, Georgia

This serves as notification from the Shore Protection Committee (SPC) and the Georgia Department of Natural Resources of a request from Simon Richardson and Robert Forrest for a Shore Protection Act (SPA) Permit under O.C.G.A. 12-5-230 et. seq. to modify an existing, single-family residential structure at 6 Lovell Avenue, Tybee Island, Chatham County, Georgia.

The applicants’ parcel is 12,081sq.ft. (0.28 acres), of which approximately 10,809sq.ft. (0.25 acres) is located within the state’s SPA jurisdiction. Existing impacts within SPA jurisdiction includes a 1,244sq.ft. (0.02acre) 1950’s era slab-on-grade, one-story, single-family residence, a 5ft. x 7ft. (35sq.ft.) outdoor fireplace, and approximately 2,025sq.ft. (0.05 acre) of maintained lawn. Total existing impacts within SPA jurisdiction are approximately 3,099sq.ft. (0.07acre).

The applicants are proposing to remove the 10ft. x 20ft. at-grade, screened and covered porch with walkway pavers (205sq.ft.) on the seaward side of the existing residence. The remaining residential structure will be elevated and expanded with a second story and covered porches. Improvements to the residence will result in two (2) stories of heated and cooled residential living space (3,216sq.ft.) and associated covered porches (328sq.ft.) on pilings above a new concrete pad (1,635sq.ft.) ground floor.

A 136sq.ft. portion of pervious paver driveway will provide access to the enclosed ground floor that will provide parking, stairs, and storage areas. The applicants propose to construct a new paver walkway (115sq.ft.) to provide access to the main entrance staircase along the northern side of the residence and a landscape bed (150sq.ft) within the existing mowed and maintained yard (1,795sq.ft.) within SPA jurisdiction.  

Proposed impacts to the State’s SPA jurisdiction total approximately 3,831sq.ft. (0.08 acres).
 
Temporary impacts associated with site preparation include clearing, grading, filling, and removal of trees in SPA jurisdiction. Two (2), existing, at-grade, beach access paths are associated with the property. A dune crosswalk is not proposed.

As proposed, total jurisdictional impacts would be approximately 3,831sq.ft. (35.4%). Approximately 6,978sq.ft. (64.6%) of the State’s jurisdictional area will be retained or restored to its natural vegetated and topographic state.

It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. In passing upon the application for permit, the permit issuing authority shall consider the public interest which for purposes of this part shall be deemed to be the following considerations:  (1) Whether or not unreasonably harmful, increased alteration of the dynamic dune field or submerged lands, or function of the sand-sharing system will be created; (2) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with the conservation of marine life, wildlife, or other resources; and (3) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with reasonable access by and recreational use and enjoyment of public properties impacted by the project.
