This serves as notification from the Coastal Marshlands Protection Committee and the Georgia Department of Natural Resources of a request from Bridge Pointe at Jekyll Sound Community Association Inc. for a Coastal Marshlands Protection Act (CMPA) permit under Official Code of Georgia (O.C.G.A.) 12-5-280 et seq., to change the use of, and modify and maintain an existing dock facility located on Maiden Creek, Camden County, Georgia. The proposed project modification is under 1/10 of an acre and therefore may be considered a minor alteration of coastal marshlands under O.C.G.A. 12-5-280 et. seq.

The existing dock facility is currently classified as a Private Recreational Dock (PRD). A Revocable License was issued September 7, 2004 (PRD20040143) to construct the dock. The existing dock facility consists of a 6.5ft. x 589ft. (3,828.5sq.ft.) walkway leading to a 28ft. x 30.4ft. (851.2sq.ft.) partially-screened and covered fixed deck with a 30.8ft. x 37ft. roof containing a second-story open deck and access stairs. Extending to the east of the fixed deck is a 3.3ft. x 26ft. (85.8sq.ft.) ramp leading to a 10ft. x 20ft. (200sq.ft.) floating dock. Extending to the west of the fixed deck is a 4.3ft. x 26ft. (111.8sq.ft.) ramp leading to a 10ft. x 40ft. (400sq.ft.) floating dock. There is no decking on the last 490.83ft. of the walkway. The existing dock facility impacts a total of 5,477.3sq.ft. (0.126 acre) of coastal marshlands.

The applicant proposes changing the use of the permitted PRD to a Tier 3 Community Dock. The marshlands component consists of modifying the dock facility to increase fixed deck size, increase floating dock space, and to perform general maintenance as necessary. The proposed modifications include adjusting the fixed deck size to 28.2ft. x 30.5ft. (860.1sq.ft.), adding a 10ft. x 26ft. (260sq.ft.) floating dock extension to the east floating dock, and adding a 10ft. x 108ft. (1,080sq.ft.) floating dock extension to the west floating dock. The second story deck and access stairs will be removed and replaced with a new roof. The proposed dock facility will extend approximately 65ft. into the waterway at a point where the waterway is approximately 380ft. at Mean Low Water (MLW). The fixed terminal end of the dock facility will extend across lots 110 and 111 and will be constructed 10.7ft. from the straight-line extended property line to the east and 10.4ft. from the straight-line extended property line to the west

The proposed dock facility will accommodate approximately 20 vessels. The dock is proposed to be first-come first-serve for all members of the HOA that do not have private docks associated with their upland property.

The upland component for the proposed project consists of a wooden walkway (372sq.ft.) leading from the dock walkway to a concrete sidewalk (2,506sq.ft.). The sidewalk will provide access from the wooden walkway to a gravel parking lot (9,560sq.ft.). A bathroom (200sq.ft.) and pavilion (200sq.ft.) will be located in the area between the sidewalk and parking lot. The remainder of the upland component consists of lawn/landscaping (16,081sq.ft.). The upland component totals 41,294sq.ft. Total proposed permanent impacts to the upland component are 28,919sq.ft. (0.664 acre).

The 50ft. marshlands buffer totals 12,690sq.ft. of which 22sq.ft. is currently impacted by a section of the wooden walkway. An additional 307sq.ft. of the wooden walkway will be added within the 50ft. marshlands buffer. Proposed permanent structures upon completion will impact approximately 329sq.ft. of the 50ft. marshlands buffer. The existing native vegetation within the 50ft. marshlands buffer will be maintained in its current condition. Currently, the 50ft. marshlands buffer is 0.2% impervious and will be 3% impervious upon completion of the project.

It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. Impacts to coastal marshlands must be minimal in size. In passing upon the application for permit, the Coastal Marshlands Protection Committee shall consider the public interest: (1) Whether or not unreasonably harmful obstruction to or alteration of the natural flow of navigational water within the affected area will arise as a result of the proposal; (2) Whether or not unreasonably harmful or increased erosion, shoaling of channels, or stagnant areas of water will be created; and (3) Whether or not the granting of a permit and the completion of the applicants proposal will unreasonably interfere with the conservation of fish, shrimp, oysters, crabs, clams, or other marine life, wildlife, or other resources, including but not limited to water and oxygen supply.
