This serves as notification from the Shore Protection Committee and the Georgia Department of Natural Resources of a request from Daniel L. Dorn and Barbara A. Dorn for a Shore Protection Act (SPA) permit under Official Code of Georgia (O.C.G.A.) 12-5-230 et. seq., for amenities associated with a single-family residential structure including a patio, stairs, covered porches, and landscaping within the State’s SPA jurisdiction at 18 Sanctuary Place on Tybee Island, Chatham County, Georgia. The proposed project is considered a minor activity under O.C.G.A. 12-5-230 et. seq.

The applicant’s property, Lot C-1, is approximately 36,382.47sq.ft. (0.835 acre), of which 16,101.57sq.ft. (0.370 acre) is located within SPA jurisdiction. The parcel is unimproved and the area within SPA jurisdiction landward of the landward toe of dune includes approximately 4,532.23sq.ft. of native coastal vegetation. Seaward of the landward toe of dune is an enhanced, man-made sand dune and a public beach (11,569.34sq.ft. / 0.265 acre) that is maintained by the City of Tybee Island (COTI). The southern limits of the parcel are within the State’s Coastal Marshlands Protection Act (CMPA) jurisdiction. It includes an existing armored access easement for the use of subdivision residents. The easement provides vehicular ingress and egress to four (4) platted residential parcels, as well as a pedestrian easement to a beach path located on Lot B-1, immediately adjacent to the applicant’s parcel. No impacts are proposed to CMPA jurisdiction in association with this request.

The applicants are proposing to construct and maintain an elevated two-story single-family residence with amenities including a patio, stairs, covered porches, and landscaping. The SPA jurisdictional area landward of the most landward toe of dune on the ground floor will include a portion of concrete patio seaward of the proposed residential structure (306.65sq.ft.). Within the footprint of the patio will be a staircase (51.38sq.ft.) to provide access to the first story deck (306.65sq.ft.). A second story covered deck (306.65sq.ft.) is also proposed. The remainder of the SPA jurisdictional area will be landscaped using native coastal vegetation (997.98sq.ft.; 0.023 acre).

Temporary impacts associated with site preparation include removal of trees, clearing, grading, and fill. The parcel is immediately adjacent to a private, shared, pedestrian beach access path. A private dune crosswalk is not proposed.

As proposed, impacts to SPA jurisdiction would be approximately 1,304.63sq.ft. (0.029 acres). Approximately 3,227.60sq.ft. (71%) of the State’s jurisdictional area will be retained in its natural vegetated and topographic state.

It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. In passing upon the application for permit, the permit issuing authority shall consider the public interest which for purposes of this part shall be deemed to be the following considerations:  (1) Whether or not unreasonably harmful, increased alteration of the dynamic dune field or submerged lands, or function of the sand-sharing system will be created; (2) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with the conservation of marine life, wildlife, or other resources; and (3) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with reasonable access by and recreational use and enjoyment of public properties impacted by the project.
