This serves as notification from the Shore Protection Committee and the Georgia Department of Natural Resources of a request from JR Lane Holdings, LLC for a Shore Protection Act (SPA) permit under Official Code of Georgia (O.C.G.A.) 12-5-230 et. seq., for amenities associated with a residential structure including covered porches and landscaping within SPA jurisdiction at #2 2nd Street, Tybee Island, Chatham County, Georgia. The proposed project is considered a minor activity under O.C.G.A. 12-5-230 et. seq.

The applicant’s property is approximately 14,627sq.ft (0.33 acres), of which 4,288sq.ft (0.10 acres) is within SPA jurisdiction. The proposed project includes removal of the existing residential structure and wooden deck that includes 601sq.ft. within SPA jurisdiction. A new residential duplex will be constructed landward of SPA jurisdiction. The applicants propose the construction and maintenance of approximately 501sq.ft. (0.01 acres) of covered porches with associated stairs on the seaward side of the residence within SPA jurisdiction. Temporary impacts associated with site preparation include demolition of the existing residential structure and outbuildings, grading, filling, and re-installation of sod (1,000sq.ft.). The parcel is adjacent to the City of Tybee Island’s public access dune crosswalk at 2nd Street. A private dune crosswalk is not proposed.

As proposed, permanent impacts to SPA jurisdiction total approximately 501sq.ft. (0.01 acre). Approximately 3,787sq.ft. (88%) of the SPA jurisdictional area will be retained in its natural vegetative and topographic state.

It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. In passing upon the application for permit, the permit issuing authority shall consider the public interest which for purposes of this part shall be deemed to be the following considerations:  (1) Whether or not unreasonably harmful, increased alteration of the dynamic dune field or submerged lands, or function of the sand-sharing system will be created; (2) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with the conservation of marine life, wildlife, or other resources; and (3) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with reasonable access by and recreational use and enjoyment of public properties impacted by the project.
